Any personal information that you provide to Banded.co.uk and the Festighoul service contracting with the website is stored and controlled by Andi Best Illustration and Design, located at Suite 4, Leigh House, 7 Station Approach, Bexleyheath, Kent, DA7 4QP.

The information collected by the aforementioned entities is specifically used to communicate with you and to process payments if necessary. We will not sell, distribute or disclose information about you or your personal usage of Banded.co.uk without your express consent or unless required or permitted to do so by law.

Please note that we do provide links to other sites, which may not be governed by this Privacy Policy and you should view the respective privacy policies of those sites for further information. Furthermore these sites may employ the use of cookies. We have no access or control of these cookies, therefore we cannot accept liability for any malfunctioning of your PC or its installed web browser as a result of your access to any other websites.

Your participation on our website may mean that we occasionally contact you with the opportunity to enter competitions. Entry to competitions is voluntary, and you are under no obligation to take up an invitation from us to enter. Should you choose to enter a competition, we will treat the information you provide with the same high standard of care as all other customer information, and use the information provided strictly within the entry terms of the competition and this Privacy Policy.

Terms and Conditions

1. The owner of this web site is Andi Best Illustration and Design whose address is Andi Best Illustration and Design, Suite 4, Leigh House, 7 Station Approach, Bexleyheath, Kent, DA7 4QP. (‘Banded.co.uk’/‘we’ /‘us’/‘our’).

2. Your contract for service purchases made through Banded.co.uk is with Andi Best Illustration and Design.

3. You must be eighteen years old to use this site. If you are under eighteen, you may only use the site in conjunction with, and under the supervision of, a parent or guardian. If you do not qualify, please do not use the site.

4. Contracts for the services offered at Banded.co.uk will subsist between you and the Banded Representative assigned to you. You undertake that each Representative may enforce their own Terms and Conditions as well as project managment standards and that such things must be discussed between you and the Representative at the point of project commencement.

5. Banded.co.uk and its Representatives do not manufacture goods, products and/or materials unless otherwise stated herein the pages of this website and generally will not out source or contract such practices as part of the service it offers. Banded.co.uk is strictly a design service and it and its Representatives will deliver unto Banded.co.uk's customers digital image and/or design files only.

6. You agree that e-mail can be used as a long-distance means of communication.

7. You undertake that all details you provide to Banded.co.uk for the purpose of purchasing services are correct.

8. All Banded.co.uk service users are eligible for displaying selected promotional and contact details on the Billed or On Tour pages of this website. You agree that all details you provide for entry on these pages will be published for anybody viewing the website to see. Some Banded.co.uk service users are eligible for displaying selected promotional and contact details in the Featured section of the Home page of this website. Andi Best Illustration and Design is the sole dictator of which users are eligable for this feature based on their frequency and volume of service usage. Details published in the Featured section will remain so for a minimum of 7 (seven) days after which point they are subject to withdrawal. You agree that all details you provide for entry into the Featured section will be published for anybody viewing the website to see. 9. If there are any changes to the details supplied by you it is your responsibility to inform Banded.co.uk as soon as possible.

Liability

10. This section applies only to the extent permitted by law. For the avoidance of doubt, Banded.co.uk do not exclude or limit any liability for (a) personal injury (including sickness and death) where such injury results from Banded.co.uk's negligence or wilful default or (b) fraudulent misrepresentation.

11. Banded.co.uk does not accept liability (except as set out below) for any errors and omissions and reserve the right to change information, specifications and descriptions of listed products and services.

12. Banded.co.uk will do its best to correct errors and omissions as quickly as practicable after being notified of them

TO THE FULLEST EXTENT PERMITTED BY LAW, BANDED.CO.UK IS PROVIDING THIS SITE AND ITS CONTENTS ON AN ‘AS IS’ BASIS AND MAKES NO (AND EXPRESSLY DISCLAIMS ALL) REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, WITH RESPECT TO THIS SITE OR THE INFORMATION, CONTENT, MATERIALS OR SERVICES INCLUDED IN THIS SITE INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. IN ADDITION, BANDED.CO.UK DOES NOT REPRESENT OR WARRANT THAT THE INFORMATION ACCESSIBLE VIA THIS SITE IS ACCURATE, COMPLETE OR CURRENT.

14. Banded.co.uk do not accept liability for any indirect loss, consequential loss, loss of data, loss of income or profit, loss of damage to property and/or loss from claims of third parties arising out of the use of or submission to the Site or for any products or services purchased from Banded.co.uk.

Miscellaneous

15. You may not permit, create unauthorized framing of, or deep linking to, the Site or the creation of derivative works thereof from any other website under your management or control.

16. In these Terms, ‘Intellectual Property Rights’ means patents, database rights, copyright, design rights (whether registered or unregistered), trade marks (whether registered or unregistered) and other similar rights, together with the right to apply for the protection of any such rights. All Intellectual Property Rights in the Site shall be owned by us absolutely.

17. Subject to the licence granted to you to use the Site, Andi Best Illustration and Design reserves all rights, title and interest in its Intellectual Property Rights in the Site. Any goodwill accruing from use of Banded.co.uk and its affiliates’ trade marks, trade and business names and service marks under this Agreement will vest in Banded.co.uk and its affiliates, as appropriate.

18. It is a crime to use a false name when submitting the Site's Sign Up form. Anyone caught wilfully entering an erroneous or fictitious order will be prosecuted to the fullest extent of the law.

19. We reserve the right to terminate this Agreement and to suspend or terminate your access to the Site immediately and without notice to you if:

you fail to make any payment to us when due;
you breach the terms of this Agreement (repeatedly or otherwise);
when requested by us to do so, you fail to provide us within a reasonable time with sufficient information to enable us to determine the accuracy and validity of any information supplied by you, or your identity;
we suspect you have engaged, or about to engage, or have in any way been involved, in fraudulent or illegal activity on the Site.

20. Banded.co.uk may amend these Terms from time to time, and place the new version on the Site. Your continued use of the Site following Banded.co.uk’s posting of any changes will constitute your acceptance of such changes. If you do not agree to any changes to these Terms, then your only remedy is to cease using the Site.

21. If any provision of these Terms shall be held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the remaining parts of these Terms and the remainder of the affected provision shall be unaffected.

22. These Terms are subject to the laws and exclusive jurisdiction of the United Kingdom.

Festighoul

Festighoul is a free service powered by Banded and that use of this service is therefore subject to the same privacy policy, terms and conditions and liability notice for the entire Banded service, shown on this page. In addition, the following terms also apply:

You undertake that all details you provide to Festighoul for the purposes of communication are correct.

By submitting details and images to the Festighoul service you accept that:

(i) we may contact you using these details regarding the service
(ii) you are authorised to submit such images as your own and without violating any copyright protection
(ii) copies of these images may be created which will be subject to modifications, alterations, distortion and/or cropping as seen fit by a Banded representative
(iii) modified, altered, distorted and/or cropped versions of your submitted imagery, bearing the Festighoul logo, will be returned to you electronically via the email address you supplied, thus completing your transaction with the Festighoul service. This returned image will from here out be deamed the "End Product"
(iv) End Products may be published on the Festighoul web page and conjunctional Festighoul promotion pages on the internet.

Banded endeavours to deliver all Festighoul End Products within 7 working days of their initial image submission, however pending the service demand, this delivery time may be delayed without notification.

Due to the creative nature of the Festighoul service your End Product may differ in appearance to that of examples published on the Festighoul web page.

If you are a user of the Festighoul streaming mp3-player facility (the Artist’s Line-Up) you agree to and acknowledge that:

(i) use of the facility is reserved only for members of the Banded Community
(ii) a fee of £6.00 is charged for a single use of the facility in addition to all fees charged for any design projects you undertake with Banded
(iii) a single use of the facility entitles the user to add one .mp3 audio track to the Festighoul Artist’s Line-Up for a period of no more than one year (365 days).
(iv) you will be notified of your single use period expiring, via email or other means of contact using details submitted by you
(v) the Festighoul streaming mp3-player is programmed to play tracks randomly and so no guarantee is made that any one track will be playing upon visiting the Festighoul web page.
(vi) the Artist’s Line-Up is an opt-in only facility and to partake you must indicate your consent to join using any of the Banded Sign Up online forms.
(vii) you have the authority to make your submission to the facility and that any .mp3 file that you tender is your own and does not violate any copyright protection

Banded reserves the right to refuse processing any imagery or audio files submitted to the Festighoul service without notifing you if it deems such material to be illegal, offensive, pornographic, abusive or generally unfit for public consumption.
